Complaint

A viewer complained that the programme’s description of Dr Beth Upton, a transgender woman, as “a biological male who identifies as a woman”, which she regarded as discriminatory in relation to the transgender community.  The ECU considered the complaint in the light of the BBC’s editorial standards of impartiality.


Outcome

The aim of reports such as this one (which concerned the judgement of an employment tribunal) is to make the subject-matter understandable and accessible, including for those who may be less familiar with the terminology preferred by people closer to the issue.  In general, this will mean using language and terms which are widely understood, accurate and, importantly, appropriate to the context.  Because of the divisive nature of the current issues concerning gender, this may sometimes result in using words or descriptions which those close to the debate may consider problematic, but it does not imply that the BBC is favouring one side over another.  The description queried by the complainant in this instance was intended to ensure all viewers, including those who may not be familiar with the terminology associated with sex and gender identity, were given a clear understanding of the issue before the tribunal, which arose from an allegation by a female nurse of discrimination, harassment and victimisation by her employer and by Dr Upton occasioned by Dr Upton’s use of a female changing room at the hospital where they both worked.  In this context, the description did not constitute discrimination against transgender people.
