BBC Radio 4's Law in Action was broadcast on Tuesday, 11 July, 2006 at 1600 BST.
A strange quirk of the current law means that you can get charged for encouraging a crime that does not happen, when you will not if you assisted in the same crime that does not happen - sounds confusing?
The Law Commission have come up with a solution. Dr Jeremy Horder, the Law Commissioner for criminal law, explains.
