Campaigners for pressure group Fathers 4 Justice are staging a protest at Liverpool Crown Court, because Cherie Booth, QC is visiting.
Colin Vallis, 42, and Dave Chesworth, 32, both from Merseyside, scaled the court on Monday morning.
Rory Wilmer, a spokesman for Fathers 4 Justice, said they are protesting during the prime minister's wife's visit because of her high-profile.
The campaigners dressed as Batman and Robin are on a first-floor balcony.
Security has been stepped up at the family court while the protest continues.
Sending a message
Police negotiators are currently talking to the pair through a window at the court in an effort to get them down.
Ms Booth is understood to be involved in a family law case which is being heard at the court.
Fathers 4 Justice says it campaigns for "children's rights to see both parents and grandparents".
Mr Wilmer said: "We knew that Ms Booth was working at the courts and we wanted to greet her as she arrived for work.
